Private Encounter Liability Policy

Assumption of Risk, Release of Liability, and Indemnification Agreement

Welcome, and thank you for choosing Critters, Reptiles, & Science; Oh My LLC for your private educational animal encounter. By reading and signing the following agreement, the Purchaser(s), [Participant or Legal Guardian Name] agree to the following Terms and Conditions:

 

Consent to Participate and Acknowledgment of Risks

I certify that I am 18 Years of age or older and have chosen to voluntarily participate in or grant the permission of participation of minor(s) in the instruction and hands-on educational encounter with the live animal ambassadors that are in the custody and care of Critters, Reptiles, & Science; Oh My, LLC while on my own private property. I understand that this encounter involves the handling of and being near live animals. I acknowledge that an encounter with live animals carries inherent risks including but not limited to: bites, scratches, allergic reactions, flight & fight responses, property damage, or illnesses associated with handling live animals, or other unforeseen injuries. I understand that live animals, even when trained and properly handled by professionals, may behave unpredictably.

 

Release of Liability

I hereby release, waive, discharge, and hold harmless [Critters, Reptiles, & Science; Oh My LLC], its owners, employees, agents, and animal handlers from any and all liability, claims, demands, losses, or damages arising from or related to participation in this encounter, including injury, illness, property damage, or death, whether caused by negligence or otherwise, to the fullest extent permitted by Utah law.

 

Responsibility for Minors

If signing for or on behalf of a minor, or minors, I certify that I am the parent(s) or legal guardian(s) and grant the permission for the minor(s) in attendance to participate in the encounter. I accept full responsibility for minor(s)’s actions and safety during the encounter and agree to supervise them.

 

Health and Conduct Agreement

I affirm that the participant(s) in attendance has/have no known medical conditions, allergies, or sensitivities that would make participation unsafe, or I have disclosed them here:____________________________________

 

I, and my attendees agree to follow all instructions provided by the encounter staff regarding animal handling and safety. Failure to follow instructions may result in discontinued participation by the offending participant(s). If safety to animals is deemed unsustainable due to the lack of instruction adherence, abuse, or disrespect to the animals or encounter staff, Critters, Reptiles, & Science; Oh My LLC, and its encounter staff retains the right to promptly discontinue the encounter without refund.

 

Property Responsibility

I acknowledge that the encounter takes place in a private residence and agree to be responsible for any damage caused by myself/ourselves, or the minor(s) and any other participants in attendance, to property, animals, or equipment of Critters, Reptiles, & Science; Oh My LLC.

Pet Policy

I agree to keep all personal animals away from the designated encounter area including domestic dogs, cats, and “exotic” species such as reptiles, amphibians, birds, and small mammals. I understand that this policy is for the safety of humans, personal pet collections, and the ambassador animals being presented.

 

Photo & Media Release

I grant permission

I grant limited permission-Please Specify________________________________________________

I do NOT grant permission

 

for photographs or videos taken during the event to be used for promotional or educational purposes.

 

Indemnification

I/We agree to indemnify and hold harmless Critters, Reptiles, & Science; Oh My LLC and its staff from any claims

brought on by third parties arising from my/our or my encounter attendees' participation or conduct.

 

Severability

If any of this agreement is found unenforceable under Utah law, the remaining provisions shall remain in full force and effect.

 

Payment Responsibilities Acknowledgement

I agree and certify that I have paid the $50 non-refundable deposit upon booking, and furthermore, I acknowledge that the remainder of payment must be paid in full at time of services rendered [Private Educational Animal Encounter].
